Acceptance of Terms

By accessing or using landandlifeandsea.com, you agree to be bound by these Terms of Use. If you do not agree, please do not use this site. We reserve the right to update these terms at any time; continued use of the site constitutes acceptance of any changes.

Original Artwork — Shop Purchases

All paintings listed in the Shop are original, one-of-a-kind works created by Stacie Mascitelli. Each piece is sold as-is; once a painting is sold it will be labeled as such on the website.

Prices are listed in US dollars and are subject to change without notice. Sales tax is calculated at checkout based on your shipping address and applicable state law.

Payment is processed securely through GoDaddy Payments. Your order is confirmed once payment is successfully completed.

Bespoke Commissions

Commission requests are subject to Stacie's availability. Submitting a photo and inquiry does not guarantee a commission slot.

No payment is collected until Stacie has confirmed receipt of your photo and confirmed she is ready to begin your portrait. A payment link will be sent to you at that time.

Once payment is received, your commission enters the production queue. Delivery is estimated at 3–4 weeks from the date payment is confirmed. This is an estimate and may vary.

Because each commission is a unique, hand-painted original created specifically for you, commissions are non-refundable once painting has begun. If you need to cancel before Stacie has started, please contact her immediately at mascitelli@att.net.

Shipping

We ship within the domestic United States only. Shipping rates are calculated based on the size of the painting: $35 for smaller works (under 20" on any dimension) and $50 for larger works (20" or greater on any dimension).

Paintings are carefully packed by Stacie. Once a package is handed to the carrier, we are not responsible for delays caused by the carrier. If your painting arrives damaged, please contact us within 48 hours with photos of the packaging and artwork.

Returns & Refunds

Because all works are original, hand-painted pieces, we do not accept returns or exchanges on shop purchases. If your painting arrives damaged in transit, please contact mascitelli@att.net within 48 hours and we will work with you to find a resolution.

Commissions are non-refundable once painting has begun. See the Bespoke Commissions section above.

Intellectual Property

All artwork, photography, and written content on this site is the intellectual property of Stacie Mascitelli / Land, Life & Sea. Purchase of a painting transfers physical ownership of the artwork only — it does not transfer copyright or reproduction rights.

You may not reproduce, distribute, or create derivative works from any content on this site without express written permission.

Limitation of Liability

To the fullest extent permitted by law, Land, Life & Sea shall not be liable for any indirect, incidental, or consequential damages arising from your use of this site or purchase of artwork. Our total liability for any claim shall not exceed the amount you paid for the specific item giving rise to the claim.

Governing Law

These Terms of Use are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Florida.
